BroadcastConnect is operated by Broadcast Service Partners LTD, a company legally based in England and Wales, United Kingdom. These Terms of Service (“Terms”) govern your use of our website, applications, and streaming services. By creating an account or using our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.
1. Acceptance and Agreement
By registering for an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You must be at least 18 years old (or the age of majority in your country) to create an account. If you are acting on behalf of a business, you represent that you have authority to bind that business.
2. The Service
We provide SRT streaming software and related web services, including account management, license and device pairing, and remote control features. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice where practicable. We do not guarantee uninterrupted or error-free operation.
3. Your Account and Security
You are responsible for keeping your login details confidential and for all activity under your account. You must notify us promptly of any unauthorised use. We are not liable for losses arising from unauthorised access where you have failed to keep your credentials secure.
4. Licences and Subscriptions
Use of certain features (including streaming modes and device pairing) may require a valid licence or subscription. Your use is subject to the terms of your purchase and any licence or subscription agreement. Fees, renewal, and cancellation terms are as set out at the point of purchase (e.g. on our Purchase page or via our third-party payment provider). We sell worldwide; prices may be displayed in your local currency where supported. You are responsible for any taxes, duties, or customs applicable in your country. You must comply with all export and import laws in your jurisdiction; we do not guarantee that the service or software is available or lawful in every country.
5. Refund Policy
We want you to be satisfied with your purchase. If you believe a charge was made in error or you are entitled to a refund under applicable law, contact us promptly using the contact details on our website, including your account email, purchase date, amount, and payment reference.
Consumer rights: If you are a consumer, mandatory rights in your country may provide a right to cancel or obtain a refund in certain circumstances (including for defective or misdescribed digital services). Nothing in these Terms limits those non-waivable rights.
Cooling-off and digital content: Where local law provides a cooling-off period for distance purchases (for example, 14 days in the UK/EU), that right may be affected once digital services are fully supplied or activated with your consent. Any waiver or limitation will only apply where permitted by law.
Non-refundable cases: Except where required by law, fees are non-refundable for partial subscription periods, unused time, change of mind after activation, or suspension/termination resulting from a breach of these Terms.
Processing: Approved refunds are returned to the original payment method where possible. Processing times depend on your payment provider and may take several business days.
6. Acceptable Use
You must use the service only for lawful purposes and in accordance with these Terms. You must not:
- transmit any content that is illegal, harmful, defamatory, or infringes the rights of others;
- attempt to gain unauthorised access to our systems, other users’ accounts, or any third-party systems;
- use the service in a way that could damage, disable, or overburden our infrastructure;
- reverse-engineer, decompile, or attempt to extract source code from our software except as permitted by applicable law;
- resell or sublicense the service without our prior written consent.
We may suspend or terminate your account if we reasonably believe you have breached these Terms.
7. Intellectual Property
We (or our licensors) own all rights in the BroadcastConnect name, branding, software, and website content. We grant you a limited, non-exclusive, non-transferable licence to use the service in accordance with these Terms. You do not acquire any ownership rights in our intellectual property.
8. Data Protection
Your personal data is processed in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR, the EU General Data Protection Regulation (where you are in the EEA), and other applicable laws in your jurisdiction (e.g. US state privacy laws).
9. Limitation of Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under the laws of England and Wales. Subject to that, we shall not be liable for any indirect, consequential, or special loss, or for loss of profit, revenue, data, or goodwill. Our total liability to you in respect of any claim arising from or in connection with these Terms or the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim (or, if greater, £100). These limits apply whether the claim is in contract, tort (including negligence), or otherwise.
If you are a consumer, your statutory rights are not affected. In the UK, the Consumer Rights Act 2015 applies. In the European Union and European Economic Area (EEA), mandatory consumer rights under EU law (including the Consumer Rights Directive) apply—nothing in these Terms limits those rights, and you may bring proceedings in the EU/EEA country of your residence. In the United States and other jurisdictions, mandatory consumer protection laws may also apply; nothing in these Terms limits any non-waivable rights you have under the laws of your country or state.
10. Termination
You may stop using the service and close your account at any time. We may suspend or terminate your account or access to the service if you breach these Terms, or for operational or legal reasons, with reasonable notice where practicable. On termination, your right to use the service ceases. Provisions that by their nature should survive (including liability, intellectual property, and governing law) will survive termination.
11. Changes to the Terms
We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. If the changes are material, we will endeavour to notify you (e.g. by email or a notice when you next log in). Continued use of the service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the service.
12. General
If any part of these Terms is held to be invalid or unenforceable, the remainder will continue in effect. Our failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and us regarding the service and supersede any prior agreements.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Subject to the following, you and we agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or the service. We may also bring proceedings in any court with jurisdiction to protect our intellectual property or confidential information.
EU/EEA consumers: If you are a consumer resident in the European Union or European Economic Area, you may also bring legal proceedings in the courts of your country of residence. The laws of your country may apply to the extent they provide you with mandatory consumer protection.
Other jurisdictions: Where the laws of your country (e.g. United States, Canada, Australia) give you mandatory rights that cannot be limited by choice of law, those rights remain available to you in the courts of your jurisdiction as permitted by local law.
